In the olden days yes (13th century Europe), not so much now.
Now, air rights are generally only to the extent that something in the air disrupts the use, and in some instances the enjoyment, of the land under the air - flyovers, no problem, if you hover, then you do run a risk of a trespassing fine; so just don't stop in the air and gawk, take pictures etc.
Semi serious question: If I had a helicopter lower me down onto the lake along with a floatation device (pontoon preferable, but I'd settle for a float tube), am I technically legal to be there fishing since it's a public lake? I'd like to pull something like this off and this feels like a great spot to try something like that.

“We just did some view rights over in Clyde Hill and we were able to determine the view was worth $600,000 -- not the land, just the right for the guy behind him to look over and have his view,” said Hagar. This article is a bit dated, but I’ve seen a discussed a number of times recently due to the crazy housing market and people wanting to protect their views. In many cases, they buy the air rights to their neighbors property rather than buying the property like the couple did in this article.

Holy shit. People are spending $600K on air.....
Let that sink in.
Those checkerboard pieces in the west are particularly awful. They essentially privatize public land. The corner crossing debate makes this all even more difficult. Not sure the Canadian laws but there is a ONx video of elk hunting on a land locked public chunk through helicopter access.
It is very well done and the focus is more on the public land and less on hunting. We have so much public land locked that it is truely incredible. Something like 15.5 million acres.
Yup. They certainly do. The passes are increasingly difficult to get on their own. Here in Washington the timber companies are engaging in exactly the same thing. Access to the fishing and hunting by permit only.

These are all real things. That is unfortunate and I’m not a fan, but in their defense can you blame them?
People dumping shit all over the place on their properties because they are too lazy to take it somewhere for proper disposal.
This state has become a littered up dump. It’s really sad to see.
There are other problems as well that they encounter but I’d have to think illegal dumping is at the top of the pile.

They really need to create a law that gives the public a right of access to reach these locked public lands. I agree, landowners have now virtually privatized these public lands as their own public playgrounds at tax payer's expense. What's the sense of having public lands if general public isn't able to enjoy them. Public lands were created for the use of the general public but that doesn't appear to happening here and needs to be looked at with having it changed. At least the timber companies are allowing fishing and hunting by permit only mainly to control littering and abuse..Those checkerboard pieces in the west are particularly awful. I tend to think they now worry more about somebody burning their future profits up. But having to deal with all the dumped garbage was doing the same thing, I suppose. That is unfortunate and I’m not a fan, but in their defense can you blame them?

Yep, that's exactly what got me thinking about this. Plus I think it would be fun to screw w/ the billionaire (in this particular instance).
Great video if anyone is interested.
