trees

In WA typically the legal burden will fall on you. A diseased tree is considered negligence, and should be on the neighbor, and if you had been fighting with the neighbor about it being a danger, then there may be relief. Not an attorney or legal advice. This is the way the insurance person explained it to me last year (2?) when the neighbors tree fell on my car. Sorry you have to deal with this.

Unless negligence can be shown (proving the neighbor had known or should have known) you get to clean it up, or hire someone to do so.
 
It’s sorta like runoff , rain , or snow melt from a neighbor not his problem , unless it’s like from a sprinkling system , that’s on him .
 
I believe the law says you. Now as the neighbor I would offer to help. Anything big probably need to get home insurance involved.

It happened to me , we get strong east winds coming of the mountains here in the Salt Lake valley , blows over semi trucks, takes roofs off etc . Neighbors hot tub cover , plus the awning over the deck containing the hot tub from the back of the house , over their house, flew across the street, parts of the awning went thru the three large windows in the front of my house , I had wood 2x4’s , aluminum roofing from the deck laying in my living room, and the rest in my front yard . It would have been nice if the neighbor would have offered to help cleanup or help getting the plywood put up to cover up where the windows used to be , until replacement, but he didn’t. He did get back all his parts from the awning , and the hot tub cover , back to his front yard to do whatever he wanted with it . :mad: He could have offered to help the cleanup , and I would have of been happy to haul the stuff away , but considering I just gave it back to him . Never a word from him about any of it .

A couple of 'when trees' fall..
Friend who lives in Portland had the big trees around his house trimmed this summer as did the neighbor on one side of his house. The neighbor on the other side declined when the tree trimming company said he had some obvious problem trees as well and would give him a good deal while trimming the others. Those strong east winds and ice buildup a couple weeks ago? My friend posted a pic on Instagram of a big tree on the 'declining' neighbor's property that had split and collapsed through the ridgeline of the neighbors house.
First winter we moved into our Sunriver home we had a strong storm with gale force winds, heard a crunch in the middle of the night...next morning found the top third of the biggest Ponderosa Pine on our property, located 6' from the edge of driveway, snapped off and laying in the driveway and street...a big branch on it just missing my Suburban. The same tree I had requested planning dept permission to remove to create more parking space and 'open up' the property, request denied.
We've been enjoying the extra parking and sun ever since...lol

A couple of years ago we had an oak that wasn’t doing well, so we finally bit the bullet, wrote a big check, and had it removed. Turns out that about half the inside diameter of the trunk had rotted, and I’m sure it would be laying across my neighbor’s house if we hadn’t cut it down.
