Navigable River Designations in Oregon

I want to know why the Sheriff decided YOU need to change your ways and not the guy who pointed the gun at you.
Evan, in 2008 I had just exited the water to see a Pacific City dory run full speed through the crowded surf break and run over surfer Cole Ortega, cutting off his arm and breaking his ribs. A good friend still in the water was able to drag him out, another surfer who is a physician rendered life saving first aid.
The swell had jumped up significantly by mid morning, making it difficult for boat operators to see surfers as they entered the cove due to the wave height, so they were all slowing down except one that was passing other boats on the way in.
The Sheriffs neglected to perform an alcohol test on the driver, a surly prick who was known to drink while fishing, and when the private investigator went to interview the driver, a fully pulled broadhead arrow was aimed at him with orders he had ten seconds to vacate the property.
The investigator felt as a former badged harbormaster and 60 ton licensed captain my written testimony that the driver of the boat was operating in a reckless fashion by both excessive speeding and not blowing his horn as required when approaching the beach zone would be key, and I was fully prepared to testify in court. Both my testimony and those of several other eye witnesses was presented to the DA by Cole's attorney.
After a prelim hearing in which the boat driver lied his ass off, as did several boat operator friends of his that had been out that day, the DA decided the whole affair was an unfortunate accident and never pressed charges of any kind against the driver.
So instead it went to a civil trial in which Cole was awarded 4M in damages. By then the boat driver had offloaded all of his assets to relatives and declared bankruptcy.
So having a shotgun pointed at someone in Tillamook County is pretty much a non event apparently.

That's a horrible story and the injustice of how it ends is a tough read. Hope Cole is doing alright these days...
